This notice describes how medical information about you may be used and disclosed, how you may obtain access to that information, and the responsibilities Wellness Pointe has concerning your information. Please review it carefully.
This notice applies to Wellness Pointe, its healthcare providers, workforce members, and service locations that are legally covered by this notice.

Your Rights
When it comes to your health information, you have certain rights. Wellness Pointe is responsible for helping you exercise those rights as required by law.
Obtain a copy of your health information
You may ask to inspect or receive an electronic or paper copy of your medical record and other health information we maintain about you. Ask us how to make the request. We will provide a copy or summary within the timeframe required by law. We may charge a reasonable, cost-based fee when permitted.
Ask us to correct your record
You may ask us to correct health information you believe is inaccurate or incomplete. We may deny the request in certain circumstances, but we will explain the decision in writing within the period required by law.
Request confidential communications
You may ask us to contact you in a particular way or at a different address. We will accommodate reasonable requests as required by law.
Ask us to limit uses or disclosures
You may ask us not to use or disclose certain information for treatment, payment, or healthcare operations. We are generally not required to agree, and we may deny a request when, for example, the restriction could affect your care. If we agree, we will follow the restriction except when information is needed for emergency treatment or another exception applies.
If you pay for a healthcare item or service completely out of pocket, you may ask us not to disclose information about that item or service to your health plan for payment or healthcare operations. We will honor the request unless the law requires the disclosure.
Receive an accounting of certain disclosures
You may ask for an accounting of certain disclosures of your health information made during the period allowed by law. The accounting will not include every disclosure. For example, disclosures for treatment, payment, healthcare operations, and disclosures you authorized may be excluded. One accounting during a 12-month period is provided without charge; a reasonable, cost-based fee may apply to additional requests when permitted.
Receive a copy of this notice
You may request a paper copy of this notice at any time, even if you agreed to receive it electronically.
Choose a personal representative
If a person has legal authority to act for you, such as a legal guardian or a person holding an appropriate medical power of attorney, that person may exercise your rights. We will verify the person's authority before taking action.
File a complaint
You may complain to Wellness Pointe if you believe your privacy rights have been violated by contacting the privacy official listed above.
You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights, by visiting:

Wellness Pointe will not retaliate against you for filing a complaint.
Your Choices
For certain health information, you may tell us your preferences about what we disclose. If you have a clear preference, tell us what you want us to do.
When permitted by law, you may direct us regarding whether we:
- Share relevant information with family members, close friends, or others involved in your care or payment for your care.
- Share information in a disaster-relief situation.
If you cannot tell us your preference, we may disclose information when we believe it is in your best interest or when necessary to lessen a serious and imminent threat to health or safety, as permitted by law.
We will obtain your written authorization for uses and disclosures that require authorization, including most uses of psychotherapy notes, most marketing uses, and the sale of protected health information. You may revoke an authorization in writing, except to the extent we have already acted in reliance on it.
Wellness Pointe does not sell protected health information and does not conduct fundraising using patient information.
How We Typically Use and Disclose Health Information
Treatment
We may use your health information and disclose it to other healthcare professionals involved in your treatment. For example, a provider treating an injury may ask another treating professional about your overall health.
Healthcare operations
We may use and disclose health information to operate the practice, improve care, train staff, conduct quality activities, manage services, and contact you when necessary.
Payment
We may use and disclose health information to bill and receive payment from health plans, responsible parties, or other entities. Although Direct Primary Care visits may operate under a membership arrangement, Wellness Pointe may bill or coordinate with third-party payers for other eligible services when applicable.
Other Uses and Disclosures Permitted or Required by Law
Subject to applicable requirements and limitations, we may use or disclose health information:
- For public-health activities, including disease prevention, product recalls, adverse-event reporting, and other authorized activities.
- To report suspected abuse, neglect, or domestic violence when authorized or required.
- To prevent or lessen a serious threat to health or safety.
- For health research when legal requirements have been satisfied.
- When required by federal, state, or local law.
- To health-oversight agencies for authorized activities.
- For workers' compensation claims.
- For certain law-enforcement or governmental purposes.
- To coroners, medical examiners, funeral directors, or organ-procurement organizations when authorized.
- In response to an appropriate court or administrative order, subpoena, discovery request, or other lawful process.
Some categories of information receive additional protection under federal or Washington law. We will follow the law that provides greater protection when it applies.
Substance use disorder records
To the extent Wellness Pointe maintains substance use disorder patient records protected by 42 CFR Part 2, those records receive additional protections. We will not use or disclose Part 2 records in civil, criminal, administrative, or legislative investigations or proceedings against a patient unless the patient provides written consent or a qualifying court order and subpoena permit the use or disclosure. Additional requirements may apply to fundraising communications involving Part 2 information.
Our Responsibilities
- We are required by law to maintain the privacy and security of protected health information.
- We will notify affected individuals as required if a breach occurs that may have compromised the privacy or security of their information.
- We must follow the duties and privacy practices described in the notice currently in effect.
- We will not use or disclose health information other than as described in this notice unless you authorize us in writing or another law permits or requires the use or disclosure.
- You may revoke an authorization in writing, except to the extent we have already acted on it.
Changes to This Notice
We may change this notice and make the revised notice effective for health information we already maintain as well as information we receive in the future. The current notice will be available upon request, at our office, and on our website.
